Zachery Tims's Cause of Death Ruling Delayed Due to Backlog and Mother's Appeal?

A Manhattan judge ruled on Monday that the NY Medical Examiner can release the cause of death of Zachery Tims as early as 48 hours of her ruling. Unfortunately, the attorney for mother Madeline Tims says it could take weeks to 'become official' which they are banking on so they can consider an appeal on the decision.

Manhattan State Supreme Court Judge Cynthia S. Kern's decision stated Zachery Tims cause and manner of death would be released but the autopsy and toxicology reports kept private.

Even though no decision has been made to appeal the courts decision, Madeline Tims' attorneys are exploring the idea which could keep the cause of death sealed records for at least another year, says her attorney Richardo Oquendo.

"I don't agree with the decision," said attorney Richardo Oquendo. "We are analyzing and assessing the merits of a possible appeal."

Judge Rules To Release Cause of Death of Zachery Tims

The day of truth is soon to come. Judge Cynthia S. Kern of the Manhattan State Supreme Court has ruled this afternoon that Pastor Zachery Tims’ cause of death should be released.

Judge has Kern ruled that “no statute prohibits the New York City Medical Examiner from releasing the cause and manner of death.”


The Orlando Sentinel reported she stated this today:

“Since information regarding the cause and manner of death is not only within the purview of the [Medical Examiner] but is fundamental to its mission, it is empowered to take actions regarding that missiion so long as such actions are not illegal,” the judge wrote. “…This court declares that, upon public inquiry, the [Medical Examiner] may release the cause and manner of death in the cases it handles.”.

Letter by Zachery Tims' Mother Was Rejected By Judge To Conceal Death

Judge Cynthia S. Kern of the Manhattan State Supreme Court has ruled this afternoon that Pastor Zachery Tims' cause of death should be released.

 Reports have also stated Pastor Zachery Tims' mother Madeline Tims submitted a four page letter to the court. In the letter, she asserted that his cause of death would be an embarrassment to her, his children, her grandchildren and his congregation.
